Supreme Court of Florida, Division B
Jul 31, 1951
53 So. 2d 525 (Fla. 1951)

Opinion

June 29, 1951. Rehearing Denied July 31, 1951.

Appeal from Circuit Court, Duval County; Claude Ogilvie, Judge.

J.A. Fitzsimmons, Fort Lauderdale, for appellants.

Harry B. Fozzard and J. Henry Blount, Jacksonville, for Arthur N. Sollee, as Zoning Director and Edward Acosta, Tom Marshall, Robert D. Gordon, Ray Greene and Joe F. Hammond, members of and constituting Board of County Com'rs of Duval County, Florida.

Rothstein Warren, Jacksonville, for A.C. Gray.

We have carefully examined the record and the briefs filed in this cause and have heard the argument of counsel at the bar of this court, and are of the opinion that the final judgment appealed from should be affirmed, without prejudice, however, to whatever rights, if any, the plaintiffs may have in a suit to abate a nuisance, which latter question is not considered here.

Affirmed.

SEBRING, C.J., and CHAPMAN, ADAMS and ROBERTS, JJ., concur.
