IN RE: DONALD LOY PETTLE APPLYING FOR REMEDIAL WRITS AND WRIT OF HABEAS CORPUS.


Writ denied. The showing made does not warrant the exercise of this Court's supervisory jurisdiction.

BARHAM, J., is of the opinion the writ should be granted.

DIXON, J., dissents from the refusal. It appears that this applicant could not have entered a plea voluntarily and intelligently because he was either suffering from serious mental illness or under the influence of tranquilizing drugs. This court has not reviewed the action of the trial court because there is no transcript of the evidentiary hearing before us.
