State ex Rel. Livas. v. Henderson

Supreme Court of Louisiana
Jun 28, 1973
279 So. 2d 684 (La. 1973)

Opinion

No. 53477.

June 28, 1973.

In re: Darrel Lynn Livas applying for remedial writs and writ of habeas corpus.

Writ denied. The showing made does not warrant the exercise of our jurisdiction.

TATE, J., concurs in the denial of an evidentiary hearing on his understanding that the contentions now raised in this court were not raised in the application to the trial court which is sought to be reviewed, namely, the allegations as to illness being used to induce a plea and as to ineffective counsel. Further, the contemporaneous transcript of the plea of guilty adequately indicates compliance with Boykin.
