Based upon our de novo review of this record we conclude that the requisite facts were established by clear and convincing evidence as required by Santosky v. Kramer, 455 U.S. 745, 102 S Ct 1388, 71 L Ed 2d 599 (1982), and that the trial court did not err in terminating respondent's parental rights to Penny Irene Wagner, ORS 419.523; State ex rel Juv. Dept. v. Farrell, 58 Or. App. 258, 648 P.2d 401 (1982).
Affirmed.
