IN RE: AUTRY LEE JONES APPLYING FOR WRIT OF MANDAMUS


Writ denied. Plaintiff's request for a trial date is premature in view of the fact that he has not complied with the pretrial procedure contained in Rule VII of the Rules of the 19th Judicial District Court.

DIXON, J., was of the opinion the writ should be granted and a trial date ordered fixed. A rule which requires a pre-trial conference before a case an be fixed for trial may be contrary to the intent and purpose of C.C.P. 1551 1571.

CALOGERO, J., is of the opinion writ should be granted.
