Proceeding pursuant to section 298 Exec. of the Executive Law to review a determination of the State Human Rights Appeal Board, dated June 10, 1970, which modified and, as so modified, affirmed an order of the State Division of Human Rights, dated January 8, 1970. Petition dismissed on the merits and determination confirmed, with costs to the State Division of Human Rights against petitioners, Metzger Associates, Inc., and Jerome Metzger, to be taxed by the County Clerk of Nassau County under CPLR 8203, 8301. In our opinion, there is substantial evidence in the record to support the findings of the State Division of Human Rights that petitioners engaged in unlawful discriminatory practices in violation of section 296 (subd. 5, par. [c], cl. [1]) of the Executive Law. Martuscello, Acting P.J., Latham, Christ, Brennan and Benjamin, JJ., concur.
