ORDER GRANTING STIPULATION AND JOINT REQUEST FOR ASSIGNMENT TO MAGISTRATE JUDGE BERNARD ZIMMERMAN FOR ALL PURPOSES


1. This matter is before the Court on removal jurisdiction pursuant to 28 U.S.C. §§ 1332 and 1441. The amount in controversy is approximately $169,240.

2. At the Initial Case Management Conference on November 6, 2007, this Court urged the parties to give serious consideration to stipulating to this matter being heard by a Magistrate Judge. The Court suggested that the parties could either simply consent to a hearing by a Magistrate Judge or express a preference for a particular Magistrate Judge.

3. At this time, assuming that such an assignment is consistent with the interests and work load of the Court, the parties jointly request that, in accordance with 28 U.S.C. § 636 subpart c, this matter be assigned to Magistrate Judge Bernard Zimmerman.

ORDER

PURSUANT TO STIPULATION, IT IS SO ORDERED.
