INSURANCE, § 494when entry of judgment against burial insurance society is error. In action on duplicate of membership certificate, issued by defendant burial insurance society, and assignment to plaintiff by beneficiary, named in duplicate, who obtained duplicate by false representations, of certain sum from proceeds of certificate, held that, under circumstances, entry of judgment against defendant society was error.

Appeal from the Municipal Court of Chicago; the Hon. VICTOR A. KULA, Judge, presiding.

Judgment reversed and judgment here in favor of defendant. Heard in the second division, first district, this court at the February term, 1943.
