Opinion
Gen. No. 41,296. (Abstract of Decision.)
Opinion filed January 20, 1941 Rehearing denied February 5, 1941
AUTOMOBILES AND MOTOR VEHICLES, § 167 — collision, evidence and instructions. Evidence that plaintiff's automobile was struck by defendant's opposite-bound truck when the truck swung across the center of the street and into the path of the automobile supported verdict for plaintiff, there was no reversible error in refusing defendant's instructions which were covered by other instructions, and defendant's instruction concerning imputed negligence in case of a joint enterprise was properly refused, as the question of a joint enterprise was not submitted to the jury and the instruction did not undertake to define it.
