ORDER


The Court has before it the Government's Motion for Reconsideration, filed on August 13, 2001. Its Notice of Appeal was filed on August 13, 2001. This Court concludes that it does not have jurisdiction to consider the Motion in light of the pending appeal. Even if it did have jurisdiction, however, it would conclude that the arguments were waived, since they were not presented in the Government's Objections to the Recommendation of the Magistrate Judge, and further, are not correct on their merits.

Therefore, the Motion for Reconsideration is DENIED.

SO ORDERED.
