Opinion

03-18-2022

ST. JOSEPH'S HOSPITAL, INC., d/b/a St. Joseph's Hospital, Petitioner, v. KATHRYN D. WILSON and TRAVIS W. WILSON Respondents.

Mindy McLaughlin and Carissa Wheeler Brumby of Beytin, McLaughlin, McLaughlin, O'Hara & Bocchino, P.A., Tampa, for Petitioner. Aaron E. Sprague and Rebecca Bowen Creed of Creed & Gowdy, P.A., Jacksonville, for Respondents.

Petition for Writ of Certiorari to the Circuit Court for Hillsborough County; Herbert J. Baumann, Jr., Judge.

PER CURIAM.

The petition for writ of certiorari is denied on the merits. See Topps v. State, 865 So.2d 1253, 1258 (Fla. 2004) (holding that an appellate decision denying a petition for writ seeking extraordinary relief "on the merits" will preclude the litigant from raising the same issue again); Coleman v. Inch, 329 So.3d 263, 264 (Fla. 1st DCA 2021) (applying Topps in denying a petition for writ of certiorari on the merits to establish a preclusive effect).

Petition denied.
