PRESENT:

Defendant City of Buffalo having moved to vacate the dismissal of the appeal taken herein from an order of the Supreme Court, Erie County, entered December 13, 2019,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted on the condition that defendant City of Buffalo files and serves its appellant's brief, with a blue cover, on or before August 14, 2020, and

It is further ORDERED that the time for defendant City of Buffalo to file and serve a respondent's brief is extended to August 14, 2020, on the condition that it is filed and served with a red cover, and

It is further ORDERED that the appeal is removed from the Court's day calendar for September 15, 2020, and is added to the term of this Court commencing October 19, 2020.
