Motion for reargument dismissed as untimely. The motion was originally returnable on August 27, 1954, and appears to have been adjourned from time to time by consent of the respective attorneys to September 13, 1955. There is no warrant in this case for such procedure. Such a motion should be submitted to the court for decision within the time specified by rule VIII of the Rules of this court.
