DECISION & ORDER ON MOTION

Motion by appellant on an appeal from an order of the Civil Court of the City of New York, Kings County, entered May 18, 2015, to modify a stay granted by decision and order on motion of this court dated December 1, 2015 so as to delete the requirement that appellant deposit the sum of $5,000 into court, on the ground that that amount has already been garnished by the marshal.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is granted and the deposit requirement is deleted.
