JUDGMENT


A Memorandum and Order of Honorable Frederic Block, United States District Judge, having been filed on November 3, 2004, dismissing the petition for a writ of habeas corpus without prejudice, to permit petitioner to exhaust this and other claims pending in the Appellate Division; it is

ORDERED and ADJUDGED that petitioner take nothing of the defendant; and that the petition for a writ of habeas corpus is dismissed without prejudice, to permit petitioner to exhaust this and other claims pending in the Appellate Division.
