ORDER


On July 29, 2003, the Court improvidently entered an order dismissing this case without prejudice. [Court File No. 8]. This was an inadvertent mistake. The Court had previously denied the defendant's motion to dismiss the complaint under FED. R. CIV. P. 12(b)(5). Accordingly, the order of dismissal mistakenly entered on July 29, 2003, is hereby VACATED and SET ASIDE pursuant to Fed.R.Civ.P. 60(b). The Clerk of Court is DIRECTED to reopen this case and restore it to the Court's active docket.

SO ORDERED.
