MEMORANDUM OPINION
Before Justices Morris, Moseley, and Myers

On March 9, 2012, the Court reinstated the appeal following abatement for bankruptcy proceedings. Appellant was told his brief was due within thirty days. By letter dated May 7, 2012, the Court notified appellant that his brief was past due. Appellant was told to file his brief with an extension motion within ten days. We cautioned appellant that failure to file his brief within ten days would result in dismissal of his appeal.
As of today's date, appellant has not filed a brief. Accordingly, we dismiss the appeal. See Tex. R. App. P. 38.9(a)(1) & 42.3(b).
