THOMAS SPIELBAUER, Petitioner v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Elizabeth Crewson Paris, Judge

This case is set for trial on December 5, 2022, at the remote Standalone Trial Session of the Court. Because this trial session is being conducted remotely, the place of trial is for administrative purposes only.

By Order dated November 2, 2022, docket entry 15, the Court directed the parties, on or before November 15, 2022, to file reports that (1) identify the specific issues remaining in dispute, (2) describe efforts that the parties have undertaken or plan to undertake to settle this matter, (3) describe the efforts that the parties have undertaken or plan to undertake to retrieve and compile an adequate administrative record to permit effective judicial review, and (4) to inform the Court whether the parties plan to file any pretrial motion(s) and, if so, the nature of such motion(s). This Order is still outstanding.

On November 7, 2022, docket entry 16, petitioner filed a Motion for Continuance of Trial. Petitioner's Motion indicates that respondent objects to the granting of this Motion. The Court will direct respondent to file a response to petitioner's Motion for Continuance of Trial.

After due consideration, and for cause, it is

ORDERED that, on or before November 21, 2022, respondent shall file a response to petitioner's Motion for Continuance of Trial, filed November 7, 2022, docket entry 16.
