ORDER OF DISMISSAL

The Court has entered its Order Accepting the Findings, Conclusions, and Recommendation of the United States Magistrate Judge in this case. The Court hereby construes Plaintiff's document, filed on June 13, 2005, as a notice of dismissal filed under Fed.R.Civ.P. 41 (a).

It is therefore ORDERED, ADJUDGED, AND DECREED, that said action against Defendant Mark Tolle is DISMISSED WITHOUT PREJUDICE pursuant to Fed.R.Civ.P. 41 (a).

The Clerk shall transmit a true copy of this Order of Dismissal, together with a true copy of the Order Accepting the Findings, Conclusions, and Recommendation of the United States Magistrate Judge, to the parties.
