Opinion

Appeal by Plaintiff from orders entered 11 December 2013 and 16 October 2014 by Judge James W. Morgan, and from order entered 27 October 2014 by Judge W. Robert Bell, all in Mecklenburg County Superior Court. Heard in the Court of Appeals 4 November 2015.

Barker, our Supreme Court held that this Court had erred when it concluded that a third-party defendant lacked standing to appeal the trial court's judgment. 326 N.C. at 472–73, 389 S.E.2d at 80405. However, the Court ultimately affirmed this Court's conclusion that the trial court's order granting summary judgment in favor of the plaintiff was correct. See id.
