ORDER
On December 7, 2023, this Court abated and referred this appeal to mediation. On December 13, 2023, Appellant SpawGlass Civil Construction, Inc. filed an Objection to Mediation, asserting that prior settlement "discussions proved to be unsuccessful" and thus, "mediation would be neither fruitful not an efficient use of party resources." Appellees Horizon Excavation, Inc., and The Hanover Insurance Company filed a response, arguing that Appellant's Objection to Mediation should be overruled because "the parties would be served greatly by mediation with a third party in an effort to continue to work toward a resolution."
Appellant's Objection to Mediation is sustained. We hereby lift the abatement and reinstate this case on the Court's active docket.
Appellant's Amended Motion to Extend Time to File Appellant's Brief until "seven days after the date of an[] order reinstating [the] appeal" is granted. See Tex. R. App. P. 38.6(d).
Appellant's brief is due to be filed seven days from the date of this order. See Tex. R. App. P. 38.6(a); (d). Appellees' brief, if any, is due within 20 days of the filing of Appellant's brief. See Tex. R. App. P. 38.6(b). Any reply brief is to be filed, if at all, within 20 days after the date Appellees' brief is filed. Tex.R.App.P. 38.6(c).
