Present — Clarke, P.J., Dowling, Finch, McAvoy and Martin, JJ.; Clarke, P.J., dissents and votes for reversal.


Judgment modified by providing that upon payment of the amount of the judgment, and as a condition for the payment of the same, plaintiff shall indorse and deliver the scrip to defendant, and as so modified the judgment and order appealed from affirmed, without costs. No opinion. Settle order on notice.
