Landlord appeals from that portion of an order of the Civil Court of the City of New York, New York County (Kevin C. McClanahan, J.), dated July l8, 2007, which granted tenants' cross motion for summary judgment dismissing the petition in a holdover summary proceeding.

Order (Kevin C. McClanahan, J.), dated July 18, 2007, affirmed, with $10 costs ( see Kaycee W. 113th St. Corp v Diakoff, 160 AD2d 573).

THIS CONSTITUTES THE ORDER OF THE COURT.
