ERIC SOUTH, KESIA SOUTH AND LATRICIA SOUTH, INDIVIDUALLY AND ON BEHALF OF THEIR DECEASED FATHER, CHARLES SOUTH v. DR. LARRY T. OLINDE AND DR. PAUL MICHAEL PETTY

Appealed from DeSoto Parish No. 22CR033045

Before PITMAN, STONE, and MARCOTTE, JJ.

ORDER

Jurisdictional check of this appeal shows that the trial court's September 1, 2023, judgment does not contain proper decretal language expressly indicating the effect of the relief awarded. Accordingly, the ruling is not a "final judgment" for purposes of an immediate appeal. La. C.C.P. art. 1918; Burch v. Burch, 51,780 (La.App. 2 Cir. 1/10/18), 245 So.3d 1138.

In accordance with La. C.C.P. art. 1918, this matter is remanded with instructions for the trial court to amend the judgment in accordance with La. C.C.P. art. 1951 within 20 days of the date of this order. Duplicate certified copies of such a judgment should be transmitted to this Court for supplementation of the record within 20 days of this order. Briefing is suspended pending supplementation and will be reissued upon completion of the record.
