Soto v. State

District Court of Appeal of Florida, Third District
Dec 7, 1993
627 So. 2d 129 (Fla. Dist. Ct. App. 1993)

Opinion

No. 93-815.

December 7, 1993.

An Appeal from the Circuit Court of Dade County; Barbara S. Levenson, Judge.

Bennett H. Brummer, Public Defender, and Rosa C. Figarola, Asst. Public Defender, for appellant.

Robert A. Butterworth, Atty. Gen., and Marc Brandes, Asst. Atty. Gen., for appellee.

Before HUBBART, COPE and LEVY, JJ.

In view of the fact that the State failed to produce any evidence to establish that the car that the appellant was found in belonged to someone other than the appellant, the trial court was in error in denying the appellant's Motion for Judgment of Acquittal.

Reversed.
