Sailany Gotera Soto Petitioner v. Commissioner of Internal Revenue Respondent

ORDER

Maurice B. Foley Chief Judge

On November 8, 2021, the parties filed a proposed stipulated decision and a settlement stipulation for the Court's consideration. On November 9, 2021, the parties filed a second proposed stipulated decision. Upon review of the first proposed stipulated decision, the Court notes that the first page of the settlement stipulation has been improperly filed therewith. Accordingly, the Court will strike the parties' first proposed stipulated decision.

In addition, the Court notes that the record in the above-docketed matter currently does not include a complete copy of the notice of deficiency upon which this case is based. Consequently, action on the parties' second proposed stipulated decision will be held in abeyance pending the filing of a report as set forth below.

Upon due consideration and for cause, it is

ORDERED that the parties' proposed stipulated decision, filed November 8, 2021, is hereby deemed stricken from the Court's record in this case. It is further

ORDERED that, on or before December 6, 2021, respondent shall file a report and shall attach thereto a complete copy of the notice of deficiency upon which this case is based. 1
