Opinion

CARLOS PAZ SORIA, Appellant, v. THE STATE OF TEXAS, State.

Appeal from the 243 District Court of El Paso County, Texas (TC# 20150D02411) ORDER

Pending before the Court is Appellant's motion to dismiss. Appellant does not seek to dismiss the appeal under TEX.R.APP.P. 42.2, and the motion does not satisfy the requirements of that rule. The sole basis of the motion to dismiss is that the trial court has purportedly not given Appellant permission to appeal. We have reviewed a copy of the trial court's certification of the defendant's right to appeal signed on November 3, 2015. The trial court judge certified that he has given Appellant permission to appeal and Appellant has a right to appeal. Accordingly, Appellant's motion to dismiss is DENIED.

IT IS SO ORDERED this 18 day of December, 2015.

PER CURIAM Before McClure, C.J., Rodriguez and Hughes, JJ.
