MEMORANDUM AND ORDER


Petitioner sought an order releasing him from custody. Based on information then provided to this court, petitioner seemed to present a special case under Mapp v. Reno, 241 F.3d 221 (2d Cir. 2001) and the court issued an order on October 23, 2001, deeming petitioner's bond satisfied by $2500 cash and a $7500 personal guarantee by family members. The government has since presented new evidence that the petitioner has an extensive criminal history including 54 arrests, of which 35 were felony arrests, and 43 convictions, of which 2 were felony convictions. The new evidence indicates that petitioner is not a special case under Mapp requiring judicial intervention.

This court's Memorandum and Order dated October 23, 2001 is vacated. The petitioner's motion for release is denied.
