No. 05-07-00567-CV (Tex. App. Sep. 18, 2007)

Opinion

No. 05-07-00567-CV

Opinion Filed September 18, 2007.

On Appeal from the 193rd Judicial District Court, Dallas County, Texas, Trial Court Cause No. 06-10868.

Before Justices WRIGHT, O'NEILL, and LANG.

MEMORANDUM OPINION

Appellants Sonic-Carrollton V. L.P., Sonic of Texas, Inc. and Volvo Cars of North America, LLC filed a petition for writ of mandamus on May 14, 2007 regarding the same trial court order and issues that are the subject of this interlocutory appeal. The Court issued its opinion conditionally granting writ of mandamus on July 11, 2007. In response to our July 11, 2007 mandamus opinion, the trial court vacated the portion of its April 30, 2007 order disputed in this appeal by its order of July 30, 2007. In light of the Court's opinion and order of July 11, 2007, the issues raised in the interlocutory appeal are moot. Accordingly, on the Court's own motion, we DISMISS this interlocutory appeal as moot.
