Opinion

No. 42547.

October 3, 1973. Rehearing Denied November 15, 1973.

Writ of Certiorari to District Court of Appeal, Fourth District, 262 So.2d 715.

Jos. D. Farish, Jr., of Farish Farish, and Sidney M. Dubbin, West Palm Beach, for petitioner.

James S. Robinson, of Alley, Maass, Rogers, Lindsay Chauncey, Palm Beach, for respondent.

The petition for writ of certiorari reflected apparent jurisdiction in this Court. We issued the writ and have heard argument of the parties. Upon further consideration of the matter, we have determined that the cited decisions present no direct conflict as required by Article V, Section 3, Florida Constitution, F.S. The writ being improvidently issued, it must now be discharged.

It is so ordered.

CARLTON, C.J., and ROBERTS, ERVIN, McCAIN and DEKLE, JJ., concur.
