Isidro Espinosa SOLIS, Appellant v. The STATE of Texas, Appellee

From the 175th Judicial District Court, Bexar County, Texas
Trial Court No. 2014CR2691
Honorable Mary D. Roman, Judge Presiding

ORDER

Appellant's brief was due April 1, 2016, but it was not filed. This court notified appellant's retained counsel, John D. Herrick, of the deficiency by letter on April 5, 2016. See TEX. R. APP. P. 38.8(b)(2). Our letter required that a brief or response be filed by April 15, 2016. Counsel has not filed appellant's brief or otherwise responded to our letter.

We order John D. Herrick to file the appellant's brief by April 25, 2016. Counsel is advised that no extension of time will be granted absent a motion filed by that date that: (1) shows good cause for an extension, (2) advises the court of the efforts counsel has expended in preparing the brief, and (3) provides the court reasonable assurance that the brief will be completed and filed by the requested extended deadline. If the brief or a conforming motion is not filed by the date ordered, the court will abate this appeal and remand the case to the trial court for a hearing to determine whether appellant or counsel has abandoned the appeal.

Luz Elena D. Chapa, Justice

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 20th day of April, 2016.
