ORDER

Lewis R. Carluzzo, Chief Special Trial Judge

Petitioner's failure to comply with the Order served December 22, 2022, could, upon appropriate objection from respondent at the relevant time, result in the exclusion of evidence offered by petitioner in support of the allegations of error made in the petition. But under the circumstances, petitioner's behavior does not, at this stage of the proceedings, support the harsh sanction of dismissal. That being so, it is

ORDERED that respondent's motion to dismiss for lack of prosecution, filed February 22, 2023, is denied, without prejudice. It is further

ORDERED that jurisdiction over this case is no longer retained by the undersigned. It is further

ORDERED that this case restored to the general docket for trial or other disposition.
