MEMORANDUM OPINION


On October 17, 2006, appellant filed a notice of appeal in this case. On October 17, 2006, we notified appellant by letter that the $125 filing fee was due. We gave appellant ten days to pay the filing fee, and we warned appellant that if he failed to comply with our directives within the time allowed, the appeal was subject to dismissal without further notice.

Further, appellant's brief was due on January 14, 2007. When appellant had not filed his brief by January 29, 2007, we sent a letter to appellant directing him to file his brief within ten days or the appeal would be subject to dismissal. Nevertheless, appellant has not paid the filing fee, filed his brief, or otherwise communicated with the Court regarding this appeal.

Accordingly, on the Court's own motion, we DISMISS the appeal. See Tex. R. App. P. 5, 42.3(c); Appendix to the Tex. R. App. P. (B)(1)(a).

DISMISSED.
