Opinion

Case No. 4D00-2230

Opinion filed September 20, 2000. July Term 2000

Appeal of a declaratory statement from the State of Florida, Department of Transportation; L.T. Case No. 00-053.

Rancy F. Snyder, Fort Lauderdale, pro se.

Gregory G. Costas, Assistant General Counsel, Department of Transportation, Tallahassee, for appellee.

We accept the Department of Transportation's confession of error in which it concedes that the Declaratory Statement on appeal contains findings of fact that have no record support. We reverse and remand this cause for a new hearing and for further proceedings consistent herewith.

REVERSED and REMANDED.

WARNER, C.J., DELL and POLEN, JJ., concur.
