This case was continued from the Court's January 23, 2023, San Antonio, Texas trial session and jurisdiction was retained by the undersigned. On April 17, 2023, the Court filed petitioner's Motion for Protective Order Pursuant to Rule 103 in which petitioner identified several instances of inadvertent disclosures of his personal identifying information. On May 12, 2023, in accordance with Rule 27(h), Tax Court Rules of Practice and Procedure, respondent submitted a Motion for Leave to File Redacted Declaration of Aftan Bryant in Support of Motion for Summary Judgment, a Motion for Leave to File Redacted First Stipulation of Facts, and a Motion for Leave to File Redacted Declaration of Aftan Bryant in Support of First Supplement to Motion for Summary Judgment in which references to petitioner's personal identifying information have been more fully redacted.

Upon due consideration and for cause, it is hereby

ORDERED that petitioner's Motion for Protective Order Pursuant to Rule 103, filed April 17, 2023, is denied. It is further

ORDERED that respondent's Motion for Leave to File Redacted Declaration of Aftan Bryant in Support of Motion for Summary Judgment, filed May 12, 2023, is granted. It is further

ORDERED that respondent's Motion for Leave to File Redacted First Stipulation of Facts, filed May 12, 2023, is granted. It is further

ORDERED that respondent's Motion for Leave to File Redacted Declaration of Aftan Bryant in Support of First Supplement to Motion for Summary Judgment, filed May 12, 2023, is granted. It is further

ORDERED that respondent's unredacted Declaration of Aftan Bryant in Support of Motion for Summary Judgement, filed November 23, 2022, is sealed and shall not be inspected by any person or entity not a party to this case, except by an Order of the Court. It is further

ORDERED that the parties' unredacted First Stipulation of Facts, filed January 10, 2023, is sealed and shall not be inspected by any person or entity not a party to this case, except by an Order of the Court. It is further

ORDERED that respondent's unredacted Declaration of Aftan Bryant in Support of First Supplement to Motion for Summary Judgment, filed January 12, 2023, is sealed and shall not be inspected by any person or entity not a party to this case, except by an Order of the Court.
