ORDER


After making an independent review of the pleadings, files and records in this case, and the findings, conclusions and recommendation of the United States Magistrate Judge, filed on October September 27, 2002, the court determines that the findings and conclusions of the United States Magistrate Judge are correct. Petitioner's objections are overruled. The findings and conclusions of the United States Magistrate Judge are hereby accepted as those of the court. Robert Norman Smithback's petition for Writ of Habeas Corpus relief is denied for failure to exhaust state remedies, and this action is dismissed without prejudice.

It is so ordered
