On December 29, 2023, we notified appellant that the brief he had filed was deficient and directed him to file a corrected brief within ten days. Although our notice cautioned appellant that failure to comply could result in dismissal of the appeal without further notice, on appellant's motion, we extended the deadline to February 20, 2024. Appellant did not file the brief but has now filed another extension motion. In his March 4th motion, he seeks an additional thirty days to file the brief, inclusive of the fifteen days already passed.
Having previously cautioned appellant that failure to file the corrected brief within ten days could result in dismissal of the appeal and having granted him an additional forty-three days to file the brief, but recognizing his receipt of the record on or about February 7, 2024, we GRANT the motion and ORDER appellant to file the brief no later than March 21, 2024.
We caution appellant that no further extensions will be granted and failure to file the brief by March 21, 2024 will result in the appeal either being submitted on the deficient brief or dismissed without further notice. See Tex. R. App. P. 38.8(a)(2), 38.9(a), 42.3(b),(c).
