Smith v. Woodbury Farms and Realty Corporation

Appellate Division of the Supreme Court of New York, Second Department
Nov 30, 1942
265 App. Div. 885 (N.Y. App. Div. 1942)

Opinion

November 30, 1942.

Action to recover damages for personal injuries allegedly caused by negligence. Order modifying defendant's demand for a bill of particulars further modified on the law so as to provide that item 7 be reinstated in the demand to the extent only of requiring additional specification by the plaintiff of the statutes, ordinances, rules and regulations claimed to have been violated by defendant. As so modified, the order, in so far as appealed from, is affirmed, without costs. The defendant, in our opinion, is entitled to the particulars asked in item 7, but only to the extent indicated. Lazansky, P.J., Hagarty, Johnston, Adel and Taylor, JJ., concur.
