ORDER OF DISMISSAL

AMOS L. MAZZANT, UNITED STATES DISTRICT JUDGE

This civil action was referred to a United States Magistrate Judge, who issued a Report and Recommendation (Dkt. #7) containing proposed findings of fact and recommendations for the disposition of such action. Having been presented for consideration, and no objections having been timely filed, the Court concludes that the findings and conclusions of the Magistrate Judge are correct, and adopts the same as the findings and conclusions of the Court.

The Court notes that the Report and Recommendation (Dkt. #7) was also returned to the Court, marked “Return to Sender - Attempted - Not Known - Unable to Forward,” and “Inmate No Longer at Facility” (Dkt. #8).

It is ORDERED the motion to vacate, set aside, or correct sentence is DISMISSED without prejudice for failure to prosecute. It is further ORDERED all motions by either party not previously ruled on are hereby DENIED.
