Smith v. State ex Rel. Dade County

District Court of Appeal of Florida, Third District
Jun 10, 1975
314 So. 2d 161 (Fla. Dist. Ct. App. 1975)

Opinion

Nos. 74-1772, 74-1773.

June 10, 1975.

Appeal from the Circuit Court, Dade County, William A. Herin, J.

Stone, Sostchin Koss, Miami, for appellants.

Richard E. Gerstein, State's Atty., and Milton Robbins, Asst. State's Atty., for appellee.

Before PEARSON, HENDRY and HAVERFIELD, JJ.

These appeals, by a surety bonding company, are from orders of the circuit court denying the company's motion to vacate estreature of bonds. We affirm upon a holding that the record does not show that the appellant presented to the trial court the grounds now urged as the basis of these appeals. See Paul v. Kanter, Fla. App. 1963, 155 So.2d 402, 403.

Affirmed.
