Cody Lon SMITH, Appellant v. The STATE of Texas, Appellee

From the 198th Judicial District Court, Kerr County, Texas
Trial Court No. B-07-057 & B-15-631
Honorable Rex Emerson, Judge Presiding

ORDER

Appellant's court-appointed appellate attorney, Angela Moore, has filed a third motion for extension of time to file appellant's brief in these consolidated appeals. We grant the motion and order Angela Moore to file the appellant's brief by May 16, 2017 (90 days after the original due date).

Counsel is advised that no further extensions of time will be granted. If the brief is not filed by the date ordered, the court will abate this appeal and remand the case to the trial court for a hearing to determine whether appellant or counsel has abandoned the appeal. Counsel may also be ordered to appear before this court to show cause why she should not be held in contempt for failing to comply with the court's order.
