The offense is driving a motor vehicle upon a public highway while intoxicated; the punishment, nine days in jail and a fine of $100.

The questions raised on appeal in this case are the same as those in Cooper v. State, Tex.Cr.App., 323 S.W.2d 949. For the reasons there stated, this judgment is affirmed.
