Smith v. State

District Court of Appeal of Florida, Third District
Nov 1, 2006
943 So. 2d 217 (Fla. Dist. Ct. App. 2006)

Opinion

No. 3D05-2458.

November 1, 2006.

A Case of Original Jurisdiction — Mandamus.

Charles L. Smith, in proper person.

Charles J. Crist, Jr., Attorney General, and Richard L. Polin, Assistant Attorney General, for respondent.

Before CORTINAS and ROTHENBERG, JJ., and SCHWARTZ, Senior Judge.

We grant Charles L. Smith's petition for writ of mandamus to compel the trial court to issue a written order of dismissal for his petition for writ of habeas corpus which was ruled upon by the trial court on July 1, 2005, in case numbers 84-20172 and 04-37311.

As we are hopeful that the lower court will comply forthwith with the issuance of the requested order, we withhold issuance of the formal writ for thirty (30) days.
