Smith v. State

District Court of Appeal of Florida, Third District
Aug 9, 2000
763 So. 2d 565 (Fla. Dist. Ct. App. 2000)

Opinion

No. 3D00-1818.

Opinion filed August 9, 2000. JULY TERM, A.D. 2000

An appeal under Fla.R.App.P. 9.140(i) from the Circuit Court for Dade County, Manuel A. Crespo, Judge; L.T. No. 89-014177.

James Smith, in proper person.

Robert A. Butterworth, Attorney General, for appellee.

Before COPE, SHEVIN and RAMIREZ, JJ.

James Smith appeals an order denying his motion to correct illegal sentence under Florida Rule of Criminal Procedure 3.800(a).

The record reflects that the appellant has raised the substantially identical challenge to his habitual offender sentence on several previous occasions, and relief was denied by the trial court and this court. The motion now before us is procedurally barred as being impermissibly successive.

Affirmed.
