Smith v. State

District Court of Appeal of Florida, Fourth District
Nov 12, 2003
859 So. 2d 1241 (Fla. Dist. Ct. App. 2003)

Opinion

Case No. 4D03-991.

Opinion filed November 12, 2003.

Appeal of order denying rule 3.850 motion from the Circuit Court for the Seventeenth Judicial Circuit, Broward County; James I. Cohn, Judge; L.T. Case No. 98-13041 CF10B.

Barry L. Smith, Bushnell, pro se.

No appearance required for appellee.

We affirm the trial court's denial of relief under Florida Rule of Criminal Procedure 3.850, without prejudice to appellant's raising claim numbers seven through nine in a timely, proper petition for habeas corpus based on ineffective assistance of appellate counsel.

POLEN, KLEIN and SHAHOOD, JJ., concur.

NOT FINAL UNTIL DISPOSITION OF ANY TIMELY FILED MOTION FOR REHEARING.
