TERIAUS MONTRAL SMITH, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 219th Judicial District Court Collin County, Texas Trial Court Cause Nos. 219-83573-2021, 219-83574-2021, 219-83575-2021

ORDER

NANCY KENNEDY, JUSTICE.

Appellant's brief is overdue. Appellant's brief was originally due May 29, 2024. On May 30, 2024, this Court notified appellant's counsel, Kristin Brown, that the brief was overdue and directed her to file appellant's brief and a motion for extension of time to file the brief within ten days. On June 24, 2024, Ms. Brown filed a motion for extension of time to file the brief, which this Court granted, ordering appellant's brief be filed by July 24, 2024. As of the date of this order, appellant's brief has not been filed.

We ORDER Ms. Brown to file appellant's brief and a motion for extension of time to file the brief on or before AUGUST 30, 2024. If appellant's brief and motion for extension are not filed by that date, this appeal may be abated for the trial court to make findings in accordance with Rule of Appellate Procedure 38.8. See Tex. R. App. P. 38.8(b)(2).
