On Appeal from the County Court at Law No. 2 Dallas County, Texas
Trial Court Cause No. CC-16-05937-B
ORDER
Before the Court is appellants' May 23, 2017 motion to extend time to file appellants' brief. We GRANT appellants' motion. We ORDER appellants to file a brief by June 26, 2017.
By letter dated March 16, 2017, the Court instructed appellants to provide, within ten days, written notice that they had requested preparation of the reporter's record and written verification that they had either paid or made arrangements to pay the reporter's fee or written documentation that they have been found entitled to proceed without payment of costs. The Court cautioned appellants that failure to comply may result in an order that the appeal be submitted without the reporter's record. Appellants failed to comply and by order dated April 6, 2017, the Court ordered the appeal be submitted without the reporter's record. Upon further review of the record, it appears appellants are indigent. Further, in their motion, appellants informed the Court of a new address and it appears they may not have received this Court's March 16th letter or April 6th order.
Accordingly, we ORDER appellants to file, within FIFTEEN DAYS of the date of this order, written verification showing they have requested the reporter's record. If appellants fail to provide the requested written verification within fifteen days of the date of this order, this Court's April 6th order will stand. If appellants provide the required written verification to the Court within fifteen days of the date of this order, this Court will vacate its April 6th order, abate the due date for the appellants' brief, and set a deadline for the reporter's record.
We DIRECT the Clerk of this Court to send a copy of this order along with a copy of this Court's March 16th letter and April 6th order to Lanetta Williams, Official Court Reporter for County Court at Law No. 2, and all parties.
