TERRY LYN SMITH v. STEPHANIE MARIE LEBEOUF


In Re: Terry Lyn Smith, applying for supervisory writs, 18th Judicial District Court, Parish of Iberville, No. 73567.

BEFORE: GUIDRY, THERIOT AND DRAKE, JJ.

WRIT GRANTED. Based on this Court's review of the writ application, including the order signed by the trial judge on May 7, 2014, and information received from the Iberville Parish Clerk of Court's Office, it appears that relator was granted pauper status in the instant matter pursuant to Louisiana Code of Civil Procedure Article 5181. Relator's civil tort petition seeks damages, but does not seek relief with respect to the conditions of confinement or the effects of actions by government officials. See La. R.S. 1181(2). The Prison Litigation Reform Act, La. 15:1181, et seq., including the pauper and stay provisions of La. R.S. 1186, is not applicable to the proceeding in this matter. Accordingly, the Clerk of Court of Iberville Parish is ordered to proceed with the processing of relator's suit, in accordance with the provisions of Article 5181.
