THEODORE SMITH v. LOUISIANA DEPARTMENT OF PUBLIC SAFETY AND CORRECTIONS


In Re: Theodore Smith, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 665719. BEFORE: WHIPPLE, C.J., McDONALD AND CHUTZ, JJ.

WRIT DENIED. The trial court lacked subject matter jurisdiction. Relator's allegations do not support a claim for declaratory relief. Rather, relator's claims are in the nature of a request for postconviction relief, which must be filed in the parish of conviction. See La. Code Crim. P. art. 925.
