Jul 30, 1990
564 So. 2d 166 (Fla. Dist. Ct. App. 1990)

Opinion

No. 89-1927.

June 20, 1990. On Petition for Rehearing July 30, 1990.

Appeal from the Circuit Court for Palm Beach County; Richard B. Burk, Judge.

Steven W. Gomberg of The Law Office of Steven W. Gomberg, West Palm Beach, for appellant.

Rhea P. Grossman of Rhea P. Grossman, P.A., Miami, for appellee.

AFFIRMED.

POLEN and GARRETT, JJ., and FRANK, RICHARD H. (Associate Judge), concur.

ON PETITION FOR REHEARING

ORDERED that Appellant's "petition" for rehearing is denied. We note that since oral argument in this case our sister court on rehearing sitting en banc in Le Grand v. Dean, 15 F.L.W. D1489 (Fla. 5th DCA June 8, 1990), reversed its panel's decision in Le Grand v. Dean, 14 F.L.W. 2201 (Fla. 5th DCA Sept. 29, 1989), a case relied upon by appellant.
